    Terms of Service

    Important Legal Notice

    Please read these Terms carefully before using PiTech's Services. By accessing or using the Services, you agree to be bound by these Terms.

    1. Acceptance of Terms

    By accessing or using the websites, applications, platforms, and related services (collectively, the "Services") provided by Canada Cyber Tech Development Group, operating under the registered trademark PiTech® ("Company", "PiTech", "we", "us", or "our"), you agree to be bound by these Terms of Service.

    The word mark PiTech and the associated PiTech design mark are registered trademarks of Canada Cyber Tech Development Group in Canada. Word mark Reference. Design mark Reference.

    If you do not agree to these Terms, do not access or use the Services.

    2. Description of Services

    PiTech provides software, automation, digital marketing, cybersecurity, communications, analytics, booking, e-commerce, and other technology-enabled products and services.

    We may modify, suspend, or discontinue any aspect of the Services at any time, subject to applicable contractual obligations.

    3. Eligibility and Accounts

    You must provide accurate information, maintain the security of your credentials, and remain responsible for activity occurring under your account.

    If you use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

    4. Fees, Billing, and Auto-Charge Authorization

    Certain Services require payment of fees, subscriptions, recurring charges, project fees, usage charges, or pass-through costs.

    By providing payment credentials, you authorize PiTech and its payment providers to charge the applicable fees in accordance with your plan, order form, invoice, statement of work, or other governing commercial document.

    Failure to pay amounts due may result in suspension, restriction, or termination of Services.

    5. Refunds and Credits

    Refunds, credits, chargebacks, and related commercial adjustments are governed by PiTech's Refund Policy and any applicable written agreement.

    Except where required by law or expressly approved in writing, fees are generally non-refundable once charged, earned, committed, or allocated.

    6. Intellectual Property and Trademark Rights

    All intellectual property rights in the Services, software, designs, branding, materials, and platform content belong to PiTech, its licensors, or other rights holders unless expressly stated otherwise.

    Deliverables created by PiTech remain the property of the Company until all applicable fees are paid in full where such condition is set out in the governing agreement.

    PiTech®, including its registered word mark and registered design mark, may not be copied, imitated, or used without authorization.

    7. Customer Content and Responsibility

    You retain responsibility for the legality, accuracy, permissions, and rights associated with any information, media, data, or content you upload, submit, process, publish, or transmit through the Services.

    You represent that you have all rights, permissions, and consents necessary for such use.

    8. Acceptable Use Restrictions

    You may not use the Services to violate laws, infringe rights, distribute malware, engage in abuse, harassment, fraud, deception, unauthorized access, unlawful marketing, or any activity that could damage the Services, PiTech, or third parties.

    9. AI, Marketing, and Performance Disclaimers

    AI-assisted outputs, analytics, recommendations, or automated features may contain inaccuracies, omissions, or results that are incomplete or unsuitable for a particular purpose.

    Marketing, SEO, advertising, and growth-related Services are provided on a commercially reasonable basis, but PiTech does not guarantee revenue outcomes, lead volume, ranking position, conversion rates, or business performance.

    10. Third-Party Services

    The Services may integrate with or depend on third-party providers, platforms, APIs, payment processors, communication vendors, hosting services, analytics providers, or advertising platforms.

    PiTech is not responsible for outages, policy changes, pricing changes, service limitations, or acts or omissions of third-party providers.

    11. Confidentiality and Data Handling

    Where confidential information is disclosed in connection with the Services, each party must use reasonable care to protect it and may use it only for lawful and authorized purposes connected to the business relationship.

    Nothing in these Terms limits obligations imposed by law, contract, or PiTech's Privacy Policy where applicable.

    12. Warranty Disclaimer

    To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.

    PiTech disclaims all warranties, representations, and conditions not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

    13. Limitation of Liability

    To the maximum extent permitted by law, PiTech shall not be liable for indirect, incidental, special, consequential, punitive, or business interruption damages arising out of or relating to the Services.

    Where liability cannot be fully excluded, PiTech's aggregate liability shall be limited to the lesser of CAD $10,000 or the fees paid for the relevant Services during the six months preceding the event giving rise to the claim, unless a different cap is required by law or expressly agreed in writing.

    14. Indemnification

    You agree to defend, indemnify, and hold harmless PiTech, its affiliates, officers, directors, employees, contractors, and agents from and against claims, damages, liabilities, losses, costs, and expenses arising from your misuse of the Services, your content, your legal non-compliance, or your breach of these Terms.

    15. Governing Law and Venue

    These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, unless a different governing law is expressly set out in a signed written agreement.

    You agree to the exclusive jurisdiction of the courts located in British Columbia, subject to mandatory consumer protection law where applicable.

    PiTech may update these Terms from time to time by posting an updated version on the relevant page.

    By using PiTech's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
